Background
Pilbara Ports Authority (PPA), holds a licence issued under Part V of the Environmental Protection Act 1986 (EP Act) by the Department of Environment Regulation (DER) for the Utah Point Multi-User Facility Bulk Handling Facility.
On 17 March 2017, PPA submitted a Licence Amendment Application to DER for the Part V licence (L8937/2015/1).
The application seeks to:
- increase the Category 58 – bulking material loading or unloading production capacity from 21.35 million tonnes per annum (Mtpa) to 24.10 Mtpa; and
- include Spodumene ore as an approved bulk material with a permitted export volume of up to 3 Mtpa.
As part of the application, a number of supporting documents were also submitted to DER:

- Attachment 1 - Utah Point Air Quality Assessment;
- Attachment 2 - Material Safety Data Sheet;
- Attachment 3 - Respirable Silica Analysis – Spodumene Run of Mine;
- Attachment 4 - Respirable Silica Analysis – Spodumene Tailings;
- Attachment 5 - Dust Extinction Moisture (DEM) Report – Spodumene Run of Mine;
- Attachment 6 - Dust Extinction Moisture (DEM) Report – Spodumene Tailings;
- Attachment 7 - Metallurgical Report;
- Attachment 8 - Metallurgical Report – Spodumene Tailings;
- Attachment 9 - Environmental Risk Assessment; and
- Attachment 10 - Spodumene Hygiene Monitoring.
What is happening now?
DER is assessing the licence amendment application in accordance with the EP Act—guided by the Department's published Regulatory Framework.
As part of this assessment, DER will consider all submissions received during the public comment period which ran from 3 April to 5 May 2017.
DER's target timeframe for determing the licence amendments is 60 working days.
