Background

Roy Hill Infrastructure Pty Ltd (Roy Hill), holds a licence issued under Part V of the Environmental Protection Act 1986 (EP Act) by the Department of Water and Environmental Regulation (DWER) for the Roy Hill Port Bulk Handling Facility and Screening Plant.

On 20 October 2017, Roy Hill submitted a Licence Amendment Application to DWER for the Part V licence L8967/2016/1.   

The application seeks to increase the Category 58 – bulking material loading or unloading production capacity from 55 million tonnes per annum (Mtpa) to 60 Mtpa. The application states that the proposed increased capacity can be achieved through the greater utilisation of existing infrastructure and no new infrastructure is proposed.

What is happening now?

Concurrent to the Part V licence amendment application Roy Hill has also submitted a request to the Environmental Protection Authority under section 45C of the EP Act to make changes to the approved production capacity at the port specified in Ministerial Statement 858.

DWER is assessing the licence amendment application under Part V of the EP Act in parallel to the section 45C of the EP Act assessment being undertaken by the Environmental Protection Authority. A determination on the Part V licence amendment application will be made subject to the outcome of the s45C assessment. 

DWER’s assessment will be undertaken in accordance with the EP Act—guided by the Department's published Regulatory Framework.

As part of the assessment of the licence amendment application, DWER will consider all submissions received during the public comment period, which is open until 28 February 2018.
