If the Chief Executive Officer of the Department of Water and Environmental Regulation is of the opinion that a person has committed a prescribed offence under section 99AA of the Environmental Protection Act 1986 and meets requirements listed under section 99A of the Act, a modified penalty notice can be given. The penalty amount specified in a modified penalty notice is 10 per cent of the maximum fine that could be imposed for that offence by a court for the first offence of that kind, and 20 per cent for subsequent offences.

In accordance with section 99E of Act as of 1 January 2022, the following modified penalties have been paid and are hereby published.

  1. Subterranean Service Locations WA Pty Ltd caused without authority, on 27 May 2020, liquid waste to be discharged on a place to which the public has access, which is an offence under section 49A(3) of the Environmental Protection Act 1986. $12,500 modified penalty was paid on 18 January 2022. The register of Certificates and Modified Penalty Notices may be inspected at the Department of Water and Environmental Regulation’s reception situated at 8 Davidson Terrace, Joondalup, Western Australia.
